Study On The Implementation Of The Procuratorial Supervision System Of China’s Prison Penalty

Penalty is the most severe sanctions, on the one hand, to meet the requirements of the people to punish criminal acts, on the other hand, the community has played a certain warning. And now China’s prisons and the execution of punishment includes imprisonment, life imprisonment and the death sentence with a two-year reprieve, and to deprivation of liberty as a means, on education and Reform for the purpose of, respect and protect inmates the legitimate rights and interests, to promote its better return to society.The procuratorial supervision is an important part of the legal supervision function of the procuratorial organs in our country, and it is an important embodiment of the theory of the balance of power in the system. Due to certain aspects of the legislative, institutional factors, it did not reach the ideal effect, lead to extended detention, illegal commutation events have occurred, after the media publicity, public opinion to render, society of prison penalty execution produced questioned or even reduce the judicial public faith force, the prison penalty execution procuratorial supervision of the problems exposed. Therefore, it is very necessary to strengthen the supervision of the execution of prison sentences.This paper is divided into four chapters to discuss the implementation of the procuratorial supervision system of prison penalty in our country. The opening chapter is based on the theoretical basis, content and function of the system. At the beginning of the third chapter, the author compares and analyzes the experience of the construction and legislation of similar systems in other countries. In the fourth chapter, the present situation and problems of the procuratorial supervision system of prison penalty execution in our country are described in detail, and the ways to solve the problem are put forward.
