With the advancement and implementation of this round of judicial reform,judicial power and responsibility are concentrated on the single court/collegial court,and its status as the main body of a judicial team is increasingly prominent,it has changed the embarrassing situation in the past,it restores the essence of justice,that is "let the judge judge,and let the judge judge."The quality and efficiency of trials have been improved.However,in the process of the gradual progress of the reform,it is found that there is a big gap between the actual operational efficiency of the trial team and the expected reform,Many new problems are emerging.Trial team in the process of operation,showing the court the absence of the current organization structure and working mechanism reform,the actual strength of the staff judges is insufficient and the pressure of handling cases is increasing.the structure of judicial assistants is aging,the number is insufficient,the recruitment is difficult and the function position is not clear.The new trial team failed to exert its improve the quality,and the effect of handling the case in practice.The reasons are that in the process of advancing the judicial system reform,most courts aren't enough careful study of the individual differences in local courts,the current organizational structure and related supporting reforms of the work mechanism of the court have not been followed up in time,the treatment of various kinds of personnel is relatively low,and the ideological work before the reform has not been achieved.In order to break through this realistic dilemma,Local governments need to fully study,evaluate and analyze problems existing in the reform,and focus on assessing and analyzing individual differences.it is necessary to reform the organizational structure and operation mechanism of the court,and redesign the reasonable design with trial and judge as the core.Further clarify the respective responsibilities of judges and trial assistants,and promote the efficient operation of the trial power mechanism.It is necessary to further improve the staff selection mechanism,improve the career security of judges and establish a strict supervision mechanism.It is necessary to improve the monetary compensation for judicial assistants,establish corresponding promotion mechanism and accurately position the functions of judicial assistants,and at the same time improve the diversion and promotion channels of clerks,so as to highlight the value of judicial assistants in the trial practice to enhance the trial efficiency and quality.
