The Criminal Law Risk Of Self-driving Vehicle And Its Treatment

Self-driving car is the latest achievement of artificial intelligence science and technology,its appearance has posed a new challenge to the current law.This paper focuses on the possible criminal law risks involved in self-driving vehicles,first of all,according to the behavior of the main classification,From two aspects of the driver and the self-driving car producer,respectively,to expound the possible criminal risks involved in driving the self-driving vehicle on the road,such as traffic accident crime and dangerous driving crime and so on.Secondly,by analyzing the present situation of the criminal law regulation of autonomous driving vehicles in our country,the author concludes that there are still obstacles in the criminal law regulation and there is no legal machine that connects civil,administrative and criminal law.System,etc.Thirdly,in order to improve the management of self-driving vehicles on the road,we should maintain the modesty of the criminal law,and not dampen the enthusiasm of producers in R & D while ensuring the development of self-driving automobile industry with the system.At the same time,the criminal law is used to regulate the self-driving vehicle only when it has actual social harmfulness.In addition,it is necessary to perfect the relevant criminal law norms of self-driving vehicles,revise the constitutive elements of the two crimes,traffic accident crime and dangerous driving crime.If necessary,we should formulate the crime of dangerous business negligence,and set up the "prohibition of practice" as a security sanction to be punished.Finally,it is proposed that our country should improve the self-driving system.On the basis of the criminal law norms related to automobiles,a set of civil,administrative and criminal legal mechanisms should be set up,and a self-driving automobile industry association should be set up in order to standardize the related activities of self-driving cars.In order to promote the development of self-driving automobile industry in China,a set of legal management mechanism is constructed to promote the self-driving automobile industry.
