Abstract/Summary:
The emergence The emergence of artificial intelligence has caused widespread concern in the judicial field.With the continuous development of artificial intelligence technology,the scope and depth of application of artificial intelligence technology in the field of justice are also expanding and deepening.As an important part of the judicial field,the field of criminal judgment is also constantly introducing artificial intelligence technology and making full use of it.However,the application of artificial intelligence in the field of criminal adjudication does not only bring a positive impact.Based on the defects and deficiencies of artificial intelligence itself,as well as some external factors,it may also lead to a black box of criminal adjudication procedures.There are a series of risks such as deviations in criminal judgment results,mechanization of criminal judgment results,and unclear responsibility for criminal judgment results.Therefore,sufficient attention should be paid to this.Based on the possible risks mentioned above,the latest practice and theoretical results can be combined through cross-disciplinary research and statistical empirical analysis methods.The latest practical results are mainly reflected in the data released in the 2018 and 2019 "China Law Research Cup" Judicial Artificial Intelligence Challenge Collection and competition results,to further clarify the specific risk performance and the degree of harm.Finally,through an in-depth analysis of the risks,the main causes of the risks are found,and then practical evasive measures are proposed for these incentives.In order to avoid the risk of developing into a substantial hazard,in addition to the continuous development of artificial intelligence technology itself,algorithm information should also be as transparent as possible within the scope allowed by law,and the criminal data used to feed artificial intelligence models should also be objective and high-quality Criminal data should be publicly shared,artificial intelligence legal systems should be set up to operate restricted areas,and the status of judicial personnel as the subject should be promoted and strengthened.
