China's current criminal law was enacted and promulgated in 1997.Although it has been revised through criminal law amendments many times,in the face of the coming artificial intelligence era,there are still many lags and limitations.The gradual popularization of artificial intelligence bodies has brought a lot of convenience to people,but also generated many risks.This article focuses on researching the risks in the artificial intelligence environment and how to deal with the criminal law.On this basis,it analyzes the artificial intelligence-related crimes caused by the emergence of new things.Specifically,it is divided into six parts:The first part gives a brief introduction to the background of artificial intelligence.On this basis,it interprets the forward-looking ideas that criminal law should uphold in the new era.The second part mainly discusses the risks generated in the artificial intelligence environment.This part is carried out from three aspects:technical risk,ethical risk,and criminal risk.It explains that the emergence of artificial intelligence as a new thing may pose a huge threat to our ethics,personal property,and even life safety,so it is necessary to increase To regulate in the criminal fieldThe third part mainly analyzes the legal attributes of artificial intelligence.This part mainly starts from the four angles of artificial intelligence body and natural people,ordinary robots,animals and units,analyzes the difference between it and other four categories of legal attributes,and in view of the particularity of its legal attributes,it is believed that it should be phased in Determine its legal attributesThe fourth part analyzes its status in China's criminal law from the two stages of weak artificial intelligence,strong artificial intelligence so as to have an accurate characterization of it,and further analyze the crimes involving artificial intelligenceThe fifth part mainly discusses the challenge of criminal law involving artificial intelligence to criminal law,starting from three aspects:whether artificial intelligence can be the subject of crime,whether it can be the subject of criminal responsibility,and the lack of artificial intelligence-related crime in the current criminal law.set forth.The sixth part mainly discusses the criminal law response in the era of artificial intelligence,and puts forward its own views from the perspectives of the necessity of criminal regulations,extra-territorial legislation and judicial reference,and specific suggestions for improving our criminal law.
