In recent years,the game live broadcast has developed rapidly.In this emerging Internet industry,the copyright issue of game live screens has been widely discussed.At present,there is a big difference in the definition of the copyright of the game live broadcast.The main reason is that the research object is not clear,and it is not possible to classify different types of games,and does not distinguish between game screens and live screens.E-sports games are different from other games,and users have the highest originality contribution in such games.Secondly,it is necessary to distinguish between the game's inherent screens,the game running screens and the game live screens.The three are present in the production stage,involving the subject and the presentation content.difference.This paper first explores the copyright of the running picture of e-sports games,and clarifies the legitimacy of the copyright of the game running screen through the theory of labor property rights,copyright incentives and social theory based on rights acquisition.It also shows and analyzes the copyright-based views of countries(regions)based on the game running screen,and at the same time,combined with the specific case,the conclusion that the e-sports game running screen belongs to the electric-like works is obtained.Then,the author reviews the copyright of the live video of the e-sports game and concludes that the live sports game PGC is an electric work,the copyright belongs to the live broadcast platform(the organizer of the event);the UCC live broadcast of the e-sports game belongs to the compilation work,and the copyright belongs to Anchor.In addition,with reference to the US "Copyright Law" to determine the reasonable use of the "four elements analysis method" to analyze the live broadcast of the game,to confirm that the game live broadcast is not a reasonable use.Finally,the infringement issue of the game live broadcast was identified.
