Research On Interests Balance In Copyright Protection Of Mobile Internet

This article has based on the strategic deployment of the party and the government on mobile Internet.To promote the effectiveness of copyright protection,the development of new industries and the balance of social and public interests as the starting point and destination.In research methods: First,through literature analysis,we can collect,identify and collate relevant literatures at home and abroad to understand the basic theories and facts related to this subject;Through combing the relevant literature,we find out the research contributions of predecessors,and find out the shortcomings.Second,through case analysis,we can collect and sort out relevant cases at home and abroad for typological research to discover the truth of the problem,to analyze the causes of the problem,and to compare the principles and standpoints of handling cases under different institutional environments.On the basis of the above research,we will improve the content of this article.The main content of this paper is to start with the historical development and characteristics of mobile Internet.And then the situation of copyright resources and the development of copyright industry in mobile Internet environment are introduced in detail.This paper demonstrates the objective impact of new copying and dissemination technologies in the mobile Internet environment,and describes the positive impact of the arrival of the mobile Internet on the copyright industry at this stage and the difficulties in copyright protection.On the basis of the foregoing,this paper analyzes the copyright protection cases brought by typical new technologies at home and abroad,such as IPTV copyright issues,mobile phone search and transcoding to provide links and summarizes the copyright protection issues.And analysis of the application of new technologies in the mobile internet environment to the fair use system and the principle of "Haven".After understanding the various technical dilemmas of copyright system in the mobile Internet era,this paper reflects on the current situation of these imbalances of interests,and explains the status quo from the two aspects of the conflict between the obligee and the public and the contradiction between the obligee and the network service provider.Finally,based on the principle of technology neutrality and balance of interests,this paper puts forward three suggestions on how to construct the balance of interests of copyright in the mobile Internet environment: first,to perfect legislation,to integrate broadcasting rights and the right to disseminate information on the Internet;second,to improve the system of fair use;third,to reconstruct the legislative provisions of the "safe haven" principle.
