Research On The Construction Of Diversified Solution Mechanism Of Family Disoutes

Family disputes are a special case of ordinary civil disputes.The general civil disputes only involve the interests of the parties.The family disputes with distinctive characteristics such as ethics,privacy and public welfare not only involve the private interests between the parties,but also Social welfare.The establishment of a multi-disciplinary mechanism for disputes in various countries has brought a new world to the trial of our country and the diversification of family disputes.In 2016,the Supreme Court carried out the trial of family trial reform in some courts across the country,which opened the prelude to the reform of the state trial system.Under the existing judicial system in our country,this paper analyzes the current situation in the reform process of the X District Court in Xinxiang City,Henan Province,and strives to find a solution mechanism for the negotiation,mediation and litigation.This article is divided into five chapters.The first chapter is the introduction part of this paper.It introduces the writing background and writing purpose of this article,as well as the literature review in this paper.It also introduces the main writing content of this paper and the process involved in the creation of this chapter.research method.The second chapter analyzes the related theories of family disputes and the mechanism of diversification of family disputes.It mainly introduces the meaning of family disputes,the overview of the diversified solution mechanism of family disputes,and the necessity of constructing a multi-disciplinary mechanism for family disputes.The third chapter presents the exploration of the family trial reform process in the X District Court of Xinxiang City,Henan Province,as well as the current practices and practical practices of the Makino District Court.The fourth chapter analyzes the current situation and existing problems of the family dispute resolution mechanism in the reform of the Family Court of the X District,Xinxiang City,Henan Province.It elaborates on the four aspects of legislation,litigation settlement mechanism,personnel setting and non-litigation settlement mechanism.At present,China's current situation,pointing out problems at the same time,paves the way for the improvement of our country's trial system.The fifth chapter is based on the first three chapters,from perfecting legislation,increasing the professional knowledge of the family mediator team,setting up specific operational procedures for the litigation and non-litigation settlement mechanisms,and playing the role of various settlement mechanisms to make litigation and non-litigation Solve the mechanism to achieve overall convergence,and build a comprehensive diversification mechanism for family disputes.
