Study On Diversified Solution Mechanism Of An Period Of Social Transformation In Rural Areas In China

China is now in an age of entire transforms, and there is a large population in its rural areas. The contraditictions and problems that brought by the foundamental transfoms of social structure, social system, benefit adjustment and changes of concept, all of which made by the Reform, are especially distinct in rural areas. On the one hand, the traditional social disputes occur very frequently, on the other hand, those new types of unexpected and sudden affairs of groups, which caused by expropriation of land, compensation for pulling down old houses, environmental pollution, management of villiage affairs and aggravating the antagonism, etc., are increasing sharply. Currently, the dredging system in rural areas is blocked, a lot of social disputes in rural areas can not be sloved in time, both of which directly cause the occurance of large amount of affairs of appealing to the higher authorities for help, letters and calls of complaint and even the criminal affairs. How to integrate it with the national conditions of the rural society, while achieving the constructive object of "rule by law", to dredge and solve the social disputes in rural communitis, has become a very difficult problem in building new socialist countryside.Practical and realistic researches should be made into the disputes in rural areas and then set up a feasible and perfect solution system, is the key to the above mentioned problems. The author believes that the solutions to the disputes always hide in the causes of those disputes. Firstly, the author tries to get back to the nature of the problems, attmpts to analyze the causes, types and psychology that the person concerned holds toward the solution of the dipute. The first step is to make it clear what problems that the solution system is supposed to solve, what their characteristics are, only through this step can we find the correct way. After that, make analysis on the current conditions of the solution system, try to understand the opinions that the people concerned holds toward the solution system and find the causes that influence the functions of the solution system, then intergrate it with the characteristics of the problems, try to set up a relatively perfect solution system with diversification, bring in and dredge those frequent disputes. Finally, the author makes efforts to discuss the value pursue of the disputes solution from the theoretical level. Since under the background of the modernization of ruling the country by law, the solution system with diversification should not only achieve its basic object—to solve and eliminate the conflicts, but also realize the object of ruling by law in the rural areas and the guarantee of the civil rights by solving those disputes, and set up the real harmonious society at last.
