Research On The Diversified Resolution Mechanism Of Rural Contradictions And Disputes From The Perspective Of The Modernization Of The Rule Of Law

After decades of exploring the rule of law,China’s modernization of the rule of law has made major achievements,providing a solid legal guarantee for the modernization of my country’s governance system and governance capabilities.As a concrete practice of the modernization of the rule of law in rural society,the "rule of law in the countryside" as one of the important tasks of realizing the rural revitalization strategy is gradually becoming a hot topic in the field of rural governance.The issuance of the "Opinions on Strengthening Rural Construction under the Rule of Law" has pointed out the direction for rural governance by law,clarified the tasks,and described a beautiful blueprint for building a socialist rural area under the rule of law with Chinese characteristics.In the "Opinions",it is clear that improving the mechanism for the resolution of rural conflicts and disputes and the construction of safety as the main task of the construction of the rule of law in rural areas,especially when the rural areas have entered a period of profound transformation and the rural conflicts and disputes have become increasingly diversified and complicated in the context of the modernization of the rule of law.The diversified settlement mechanism of rural conflicts and disputes under the perspective will surely play a more important role in rural governance.As a concrete practice of modernization of the rule of law in rural society,the rule of law in rural areas plays a fundamental and decisive role in the process of modernizing the rural governance system and governance capabilities.We must clarify the connotation of the modernization of the rule of law,fully grasp the main goals and basic principles of the rule of law in the rural areas,and conduct research on the diversified settlement mechanism of rural social conflicts and disputes under the guidance of the theory of rights relief and collaborative governance theory in the perspective of the modernization of the rule of law.At present,the types of conflicts and disputes in rural social conflicts are diversified,and they generally show the characteristics of diversified subjects,complicated objects,expanded fields,and gradual increase in the number of disputes.In dealing with the above-mentioned conflicts and disputes,my country’s current litigation and non-litigation dispute resolution methods have played an important role.However,in the process of improving the diversified resolution mechanism for rural conflicts and disputes,there has been a lack of awareness of source prevention,unsmooth channels for expressing appeals of the masses,insufficient coordination of interests,uncoordinated connection between litigation and non-litigation mechanisms,lack of perfect guarantees,and multiple prevention and mediation of social conflicts.Resolve imperfect and other practical dilemmas.To this end,we should further use the "Opinions on Strengthening the Construction of the Rule of Law in Rural Areas" as a guide,clarify the overall goals and specific tasks,and combine the actual conditions of the villages to study the source governance mechanism,the mass appeal expression mechanism,the interest coordination mechanism,and the connection of complaints.Six specific mechanisms,including the linkage mechanism with the arbitration lawsuit,the rights protection mechanism,and the comprehensive mechanism for the multiple prevention,mediation and resolution of social contradictions,try to make suggestions for improving the multiple resolution mechanisms for rural conflicts and disputes in the sight of the modernization of the rule of law.
