Research On Network Security Administrative Lawenforcement Of Public Security Organs

As the basic law of cyberspace security in China,the "People’ s Republic of China Network Security Law" is the first fundamental and comprehensive law of cybersecurity in our country.It has marked the normalization governance of cybersecurity since it official implement on June 1st,2017 and its related administrative enforcement behaviors are on the right track gradually.The legal liability stipulated in the specific clauses means that the law has entered the practical operation level,which is of great significance for implementing the administrative counterparts supervision and management obligations of network security,strengthening the main responsibility of law enforcement and promoting the overall process of cyberspace governance according to the law in China.However,in the face of the complicated network security situation at home and abroad,the "1+X" network supervision system adopted by "Network Security Law" has fundamental defects.For example,multiple management in network security supervision,and the functions of various departments are cross-cutting,more or less independently.One of the purpose that why the author writes this paper is to discuss the necessity and importance for establishing and improving the administrative enforcement laws,regulations,local laws and departmental rules of public security organs through the analysis of the domestic and international cybersecurity legislation and the public security organs maintaining cybersecurity enforcement status in the historical background of safeguarding national cybersecurity.The second purpose is to clarify the main responsibility and power boundary that should be given to the public security organs in cybersecurity administrative enforcement.It puts forward suggestions on the construction of the cybersecurity administrative enforcement system and the internal and external collaboration mechanism of the public security organs.It breaks through a series of enforcement dilemma caused by laws,systems and mechanisms.It deepens the standardization construction of the cybersecurity enforcement in the public security organs and improves the enforcement credibility and people’ s satisfaction.
