Enforcement Of Public Security Organs Network Boundary

In recent years, with the rapid development of Internet, the network security threatsand network illegal and criminal activities have been increasing day by day. In order tochange the phenomena, the public security organs, as the mainstay of the network lawenforcement, should as soon as possible strengthen the management of the socialnetwork, maintain the order of the Internet society and improve the level of lawenforcement network. However, the unclearness of the authority’s boundary discountsthe effect of the law enforcement. Meanwhile, series problems in the enforcementseriously restrict the improvement of the law enforcement, which will not only do badlyto the maintenance of the Internet security and the sanction of the internet crime, butalso go against the build of a harmonious socialist society. Thus, to clear the boundaryof the network law enforcement power is crucial to promoting of the law enforcementability. This paper will focus on the existing legislation to analyze the boundary ofChina’s public security organs’ law enforcement, and to propose some correspondingcountermeasures on the promotion enforcement power by exploring the dilemma of it.The article is mainly divided into six parts. The first part is the introduction, whichbriefly explains the background and practical significance of this issue. The second partcentrally and locally summarizes the legislation relative to the network security. In viewof network law enforcement power of public security organs, the third part discusses thepublic security organ network of administrative law enforcement and criminal lawenforcement power content and its main areas. Beginning with the"3Q War" and "SwordAction", the fourth part describes the existing condition of other administrative subjects’enforcement towards network security. The fifth part analyzes the enforcementdifficulties confronted by the public security organ from the aspects of law,organizational framework, science and technology, talents, and enforcementenvironment. The last part, proposes corresponding countermeasures to promote thepublic security organ network law enforcement powers, including improving thenetwork law enforcement basis of public security organs from the legal system; fromthe management system, rationalize the system of the network law enforcement ofpublic security organs; from the point of view of strengthening the police with science and technology, accelerate technology development and enhance scientific andtechnological prevention; from the police themselves, improve the comprehensivequality of network law enforcement team; from the law-enforcing environment,strengthen international cooperation in network law enforcement. Generally speaking,expecting to make the public security organs better define the boundary of lawenforcement, and correct exercise of power, improve the network law enforcement levelto protect the legitimate rights and interests of citizens. Consequently, effectivelysafeguard the Internet network security and fight against Internet illegal and criminalactivities, to promote the harmonious development of the Internet society.
