Research On The Legal Issues Of Sharing Company Operation In The Perspective Of Sharing Economy

The concept of shared economy as a revolutionary social innovation and development was set forth in the last century.It arsies from the value discovery of idle resources and the maximization of excess capacity and begins to develop from the cooperative consumption,and gradually becomes a new economic phenomenon which presents network platform and point-to-point connection as the core.Nevertheless,while shared economy brings convenience to human production and life,it also brings great challenges to the existing legal system and confusion to government supervision and judicial adjudication.As there exists ambiguous legal characteristics and definition of powers and responsibilities of the internal institutions in the shared economy market,this paper takes the connotation,characteristics and civil legal relationships of the shared economy as the starting point,aiming at the different types of companies in the new model of shared economy,analyses their different status quo of their operation.And based upon the summary of the existing laws and regulations,this paper analyses the dilemma of the current law application,and summarizes the common ground.There are three problems in the operation of share company:security of deposit and prepayment of rent,infringement of related interests between the company and users,and acceptance of related liabilities in the operation of share company.Through the analysis of the legal problems in this field,the corresponding solutions are put forward.Firstly,we should strengthen the supervision of deposit and prepaid rent,clarify the subject of supervision and its responsibilities;secondly,we should protect the relevant interests of all parties in the operation of the shared company according to law and safeguard their respective legitimate rights and interests;finally,we should identify the liability accidents in the operation of the shared company according to law,and clarify the subject of legal responsibility and the way of assuming it.On the basis of the form of shared economic facts,effective supervision and regulation are carried out on various legal issues in the operation of shared companies from the perspective of shared economy,and they are brought into the track of legalization to achieve sound,stable,green and sustainable development of shared economy.
