At present,China is in a critical period of economic transformation.In recent years,new changes have taken place in labor relations: individual labor relations have gradually turned to collective labor relations,the types of labor disputes have shifted from individual disputes to collective labor disputes with a large number of workers on one side,and the nature of disputes has changed from rights disputes to complex and diverse interests disputes,even two kinds of disputes.Mixed controversy.The existing collective labor dispute settlement mechanism can not effectively solve the contradictions between the employers and the employees.Generally,the government intervenes in administrative intervention.This approach fails to establish a diversified and long-term problem-solving mechanism,and can not effectively resolve the deep-seated contradictions between the employers and employees.Poor handling may also lead to deep-seated social problems,which may lead to group labor disputes becoming group events affecting social stability.The handling mechanism of collective labor disputes also needs to keep pace with the times.The solution of collective labor disputes will help workers and enterprises change from tense labor relations to harmonious and stable labor relations.This paper studies the legal issues concerning the settlement of collective labor disputes,which includes four parts.The first part mainly discusses the concept,characteristics,differences between individual labor disputes and collective labor disputes,the nature of two types of collective labor disputes and the effectiveness of collective labor disputes.The second part introduces the International Labor Organization Conventions and the legal provisions of the United States,Britain,Japan and Germany on collective labor disputes,and the experience of the construction of collective labor disputes in China.The third part analyses the current situation of legislation at the central and local levels in dealing with collective labor disputes in China and the problems existing in collective labor disputes of rights and interests.The fourth part is the legal suggestions to improve the handling of collective labor disputes in China.Settlement of collective labor disputes needs to improve the legal system of dispute settlement,distinguish different types of collective labor disputes,grasp their respective characteristics and nature,think about different ways of dealing with disputesand put forward relevant suggestions for improvement.
