Determination Of Subjective Knowledge In The Crime Of Transporting Drugs

Since the crime of transporting drugs is harmful to society and the rate of proliferation is extremely fast,countries around the world are affected to varying degrees.Countries are investigating ways to deal with drug crimes.In addition,the rapid development of new transportation systems in recent years has made the way of transporting drugs unconventional.In particular,some actors use modern,high-tech and other means to contact overseas drug lords for drug trafficking activities,which further increases the difficulty of collecting evidence and handling cases.Dangerous.In order to regulate the crime of transporting drugs,China has provisions on the crime of transporting drugs in the Criminal Law and some judicial interpretations,but these regulations cannot properly solve the dilemma in practice.The article is divided into four parts.The first part discusses the basic problems of "subjective knowledge" in the transportation of drug crimes.Firstly,it briefly introduces the criminal composition of the crime of transporting drugs,and then briefly sorts out the known contents of the crime of transporting drugs.The second part introduces the method of “knowing” in practice and evaluates it through typical cases.The third part mainly discusses the status quo of "subjective knowledge" in the transportation of drug crimes,and points out the problems existing in the current legislative provisions and judicial determination.The fourth part puts forward the perfect suggestions for the subjective and explicit identification of transporting drug crimes in the third part.
