In today's times,the Internet is everywhere in our lives.People's lives have been facilitated by the development of Internet technology.However,the Internet is like a double-edged sword.It brings convenience and comfort to people and causes many social problems-The violation of citizens' personal information is not uncommon,which poses a serious threat to citizens' life and safety and personal and property safety.In 2016,the Xu Yuyu case was alarmed throughout the country,and college students lost their lives due to telecommunication network fraud.At the beginning of the new year in 2018,Alipay's annual bill was slammed by the default selection of the Sesame Service Agreement.The protection of citizens' personal information in the network environment has begun to receive the attention and attention of the whole society.China has also actively made major breakthroughs in criminal legislation,constantly increasing the regulations on personal information protection,and improving the legal protection system in order to punish violations of citizens' personal information.The Criminal Law Amendment(VII)sets up an independent offence of infringement of personal information.The Criminal Law Amendment(IX)extends such crimes and strengthens the protection of citizens' personal information.The Supreme People's Court and the Supreme People's Procuratorate have also taken measures to actively improve the legal protection system for citizens' personal information,and jointly issued the "Interpretation of Several Issues Concerning the Application of Laws in Handling Criminal Cases of Infringement of Citizens' Personal Information"(hereinafter referred to as "Judicial Interpretation of Personal Information").Various aspects have detailed provisions on the crime of infringing citizens' personal information.This is a major improvement in the protection of citizens' personal information in China's criminal law,but there are still some imperfections.This article will combine the useful experience of criminal protection of foreign citizens' personal information,and at the same time carefully analyze the progress and limitations of China's legal protection system,so as to propose effective and effective countermeasures against the violation of the citizen's personal information crime under the network environment from the perspective of criminal law..It is mainly discussed in the following sections.The first part is mainly an overview of the personal information of citizens.The definition of citizen's personal information definition is clarified,and the characteristics of citizen's personal information are summarized.On this basis,the characteristics of citizen's personal information in the network environment are analyzed,and the direction of criminal law protection of citizen's personal information in China's network environment is pointed out.The second part expounds the current situation of the violation of the personal information of citizens in the network environment and the harmful consequences caused by illegal violations,and then draws the necessity and urgency to strengthen the criminal law protection of citizens' personal information under the network environment in China.The third part analyzes the measures to protect the personal information of citizens from countries and regions outside the region,and summarizes the useful legislative experience and protection methods,in order to provide reference for the improvement of China's relevant protection system.The fourth part is a reflection on the current legal protection system for citizens'personal information in China,including criminal law and non-criminal law.Analyze the shortcomings,and put forward targeted and perfect suggestions,in order to protect the personal information protection of citizens under the network environment in China.
