A Study On The Related Legal System Of Mental Health Service For Prisoners

The Mental Health Law of the People's Republic of China came into effect on May 1,2013.It's the first time that our country has introduced legislation into mental health work.It effectively fills the legal vacancies in the field of mental health in our country and marks that our mental health work really has special legal support and protection.The Mental Health Act incorporates mental health services such as the popularization of mental health knowledge,psychological counseling and treatment among Chinese citizens into the scope of the adjustment of the Act,which has also had a positive impact on the mental health of prisoners,and has also put forward new requirements for prisons.Based on the problems encountered in the practice of mental health education for prisoners in basic prisons,the author hopes that through this study,combining the legal perspective with the actual work,the mental health service for prisoners will be considered and prospected.This article is divided into five parts to elaborate the related legal and institutional issues of mental health service for prisoners.The first part elaborates the general analysis of the connotation of mental health service for prisoners.On this basis,the definition of psychological counseling and psychotherapy in the Mental Health Law and the effective boundary demarcation and duty orientation of psychological counseling and psychotherapy for prisoners carried out in prisons are carried out.The second part elaborates the domestic and foreign legislation and practice inspection,taking this as an opportunity,reviews the domestic "Mental Health Law"practice inspection,compares the domestic and foreign related laws horizontally,and finds a new way to carry out "special group" mental health service in the existing research and development.The third part,taking Y prison in F Province as an example,observes and analyses the current situation and difficulties of mental health service for prisoners in China,including the changes and effects of the actual working methods of prisoners'mental health service since the promulgation and implementation of the Mental Health Law,as well as the psychological disease diagnosis for prisoners.The dilemma of the clinic.The fourth part focuses on the analysis of the reasons for the predicament of the mental health service of prison inmates from the perspectives of the imperfect legal system,the unclear standards and legal responsibilities of the prison police,the unsystematic legal supervision mechanism,and the specific problems existing in the diagnosis and treatment mechanism.The last part is based on the actual development of the mental health service work of the prisoners,the problems found and the existing methods to solve these problems,and the corresponding improvement of the future development of prison staff's mental illness diagnosis and treatment work.The countermeasures and rationalization suggestions hope to provide a reference for the practice and research of mental health services for the prisoners.
