Research On Cohesive Paths With Inner Regulations Of The CPC And National Laws

Both the inner-party laws and the national laws belong to the socialist rule of law system with Chinese characteristics,which is the basic compliance of the Communist Party of China in governing the country.The fourth Plenary session of the 18 th CPC(the Communist Party of China)Central Committee brought the inner-party legal system into the system of ruling by law with Chinese characteristics,and put forward that "pay attention to the cohesion and coordination between the inner-party regulations and the national laws".The 19 th CPC National Congress clearly requires that the inner-party system of laws and regulations and national laws be perfected.In practice,there are differences between the inner-party law and the national law in adjusting the object,the scope of regulation,the way of execution and the degree of standardization of the text,which leads to the problem that the two do not converge and do not coordinate.Not only hindered the construction of the rule of law system with Chinese characteristics,but also to China The Communist Party's strict administration of the Party and the improvement of its ruling ability have a negative impact.Therefore,how to promote the coordination of inner-party laws and regulations and national laws has become an important proposition urgently discussed in academia.The theoretical research of political science should be based on the general law of socialist rule of law and the political reality of China,and the relationship between them should be studied on the theoretical basis of the dualistic relationship between the political party and the state,out of the traditional thinking pattern of the theory of party-building theory.This paper adopts the methods of literature review,institutional text analysis and so on,Through the interpretation of the core concept,the paper analyzes the necessity and paths of the cohesion between the inner-party laws and the national laws.At present,the difficulties in the connection between the inner-party regulations and the national laws are mainly as follows: lack of overall planning for legislation and legislation;inadequate enforcement of internal regulations and administrative law enforcement;imperfect supervision mechanism for the accountability review of inner-party regulations and national laws;The subject and principle of abiding by laws and regulations are notregulated.The root causes are the lack of overall planning in the formulation of inner-party regulations and national laws,the differences in the cognition between inner-party law enforcement and administrative law enforcement subjects,the need to improve the accountability mechanism of party members and cadres.Some party members and cadres need to strengthen their consciousness of abiding by discipline and law,which restricts the realization of effective connection between Chinese inner-party laws and regulations and national laws.The effective link between inner-party laws and national laws should be realized by establishing and perfecting the mechanism of "party leading legislation",perfecting the enforcement and supervision mechanism of the constitution and law of the ruling party,and improving the implementation and supervision mechanism of the ruling party.The Communist Party of China supports the judicial mechanism and ensures Party members and cadres to abide by the Party rules and national laws in four aspects to improve,and further to promote the rule of the party and the rule of law to promote the overall promotion of the integration of construction.
