Research On Compliance Mechanism Of World Anti-Doping Code

With the development of international sports events,the influence of sports events has increased,and the problem of doping in sports events has also attracted wide attention from the international society.The World Anti-Doping Agency also attaches great importance to such issues.Based on the characteristics of the use of doping,A mechanism to promote compliance by signatories with the World Anti-Doping Code--World Anti-Doping Code compliance mechanism came into being.In the original compliance mechanism,there are problems that the specific obligations of the signatories are unclear,the discretionary powers of the WADA are too large,the enforcement of penalties is too dependent on the parties,and the supervisory enforcement mechanism is not mandatory.The outbreak of the Russian doping scandal caused reforms to the original compliance mechanism,which ultimately led to the revision of the World Anti-Doping Code and the development of International Standards for Code Compliance by Signatories.The World Anti-Doping Code compliance mechanism consists of a system of compliance investigations,a system of compliance corrections,a system of compliance punishment and a system of dispute settlement.The combination of these four systems will help to better promote compliance by signatories with the World Anti-Doping Code,thereby creating a clean and fair environment for sport field.The current World Anti-Doping Code compliance mechanism has a fairly solid theoretical foundation,and both economics and international relations provide theoretical support;the entire compliance mechanism is complete;and the mechanism design is flexible,not only for critical non-compliance and general non-compliance are distinguished and the principles of social dialogue are followed.At the same time,there are still some areas for improvement.There are more or less deficiencies in the system of compliance investigations,system of compliance corrections and system of compliance punishment,such as the lack of supervision of WADA and the compliance issues of the third parties has not been addressed,the issue of the suitability of the consequences,and so on.With the continuous deepening of China's international communications,China's sports influence is also growing.China wants to better cope with the World Anti-Doping Code compliance mechanism.It must improve the domestic relevant rules system and contact the World Anti-Doping agency frequently,promote domestic sports legislation,etc.
