A Study On The Clause For Punishing The Abuse Of Cocaine In The World Anti-Doping Code

In recent years,the penalties for utilizing cocaine become controversial since the number of doping cases has increased dramatically,the penalty is severe that is made by WADA within international sports.From the WADA point of view,cocaine has always been sabotaging sports fairness and putting athletes at potential health risks.As well,cocaine has been listed on the prohibited list and it can ruin sportsmanship by using it.Cocaine is a special substance,it has various ways to enter the human body.The produced excitement is very limited with a long term process through organs which made many athletes pay the price.The punishment is based on the knowledge of the impact of physiological and the law according to the World Anti-Doping Code.For a long period of time,it has become a problem for an excessive penalty on cocaine violations determined from the World Anti-Doping Code.World Anti-Doping Code 2003 and 2009 state that cocaine violations can be banned from the tournament for 2years.World Anti-Doping Code 2015 has changed to 4 years.Also,it has a complex procedure for showing evidence by the defendant.Amending the regulation tends to be more devastating than ever since they believe cocaine has a very limited effect on athletes' performance.By World Anti-Doping Code 2021 reduced the penalty for being used cocaine.Although,the new regulation has shown a positive side on the principle of proportionality,unify anti-doping,and arbitration resources;however,when we analyze in-depth,there are still some problems in the application of the new clause,such as the restrictions on athletes' invocation of clause 10.6 defense,the limitations of treatment plan provisions,and the exclusion of Caine from multiple disciplinary penalties.WADA is the most expert organization worldwide,the purpose is to invigilate excitant within the international sport to protect athletes to have a fair and equal competition.Cocaine as a recreational drug that has many different than excitant,which makes WADA more challenging to control and monitor.After analyzing the rights of using cocaine that is monitored by the WADA organization,and countries have different tolerance according to the law.This article suggests that to remove cocaine out of the prohibited list.The suggestion has posted by the government in different counties on controlling cocaine intake.The goal is to prevent athletes receive over scale punishment in the meantime to effectively discourage cocaine usage.
