Research On The Legal Guarantee Of University Teachers's Academic Freedom

According to China's current Constitution,Teacher Law,and Higher Education Law,academic freedom should be a basic right granted to university teachers by national laws.The main function of this right is to fully respect and guarantee the academic freedom of college teachers,enabling university teachers to do their jobs with greater peace of mind and fully mobilizing the creative enthusiasm and sense of responsibility of college teachers.It is of great significance to study the legal guarantee of academic freedom of college teachers.Only when the law fully respects and guarantees academic freedom,can college teachers' relevant rights referring to academic freedom be truly exercised.For the moment,the existing literature in China on the academic freedom of college teachers is mostly in the fields of higher education,philosophy,social science,etc.,and the academic freedom of college teachers is rarely paid attention to and favored by law scholars.Therefore,based on the research of existing theoretical achievements,this thesis tries to study college teachers' academic freedom guarantee from the perspective of law.This paper is divided into five parts for corresponding analysis and research.After analyzing and researching the basic issues of academic freedom and the legal guarantee of college teachers' academic freedom,this paper will analyze the current situation of college teachers' legal guarantee of academic freedom in China.Through the research on the current constitution and common law in China,it is found that there are a good deal of problems existing among college teachers' academic guarantee,for instance,uninitiated connotation and extension of academic freedom,exorbitant administrative power attached to academic freedom,limited laws and regulations support,imperfect legal relief system.In order to better solve the existing problems,this paper puts forward relevant suggestions on college teachers' legal guarantee of academic freedom in China with a reference to oversea legal protection experience of academic freedom from the United States and Japan.First of all,the relevant legislation of academic freedom must be improved.Secondly,the legal relief system of academic freedom must be fully established.Thirdly,an internal academic operation mechanism in colleges and universities must be built and corresponding concrete measures and methods should be proposed.Through the soundness and improvement of college teachers' legal guarantee for the academic freedom,we can better promote the innovation and development of Chinese colleges and universities,realize the talent strategy of rejuvenating the country through science and education,and lay a solid cultural and talent foundation to realizing the dream of the great rejuvenation of the Chinese nation.
