As an important standard for the realization of workers' rights,the guarantee of equal rights plays an increasingly important role in the current research on the protection of workers' rights and interests.How to ensure the protection of human rights in the field of labor and employment is one of the key issues attracting the attention of the international community and various countries and regions.China started relatively late in the field of anti-employment discrimination,and there are problems that cannot be ignored in both legislative and judicial levels.Even though the concept of protecting human rights and equality has been reflected in the constitution for a long time,in practice,relevant laws and regulations and punishment systems are insufficient in the face of endless employment discrimination.Therefore,based on China's special national conditions,learning from the experience of other countries or regions in the employment discrimination judicial relief system,the establishment of employment discrimination judicial relief system in line with China's actual situation,the discrimination in the field of labor regulation and protection of labor equality is of great significance.This paper is divided into three parts:The first part briefly introduces the concept of employment discrimination and the judicial relief system of employment discrimination,thus demonstrating the necessity of the judicial relief of employment discrimination as the main topic of this paper.The second part starts from the current situation of China's anti-employment discrimination judicial system,analyzes the problems in China's anti-employment discrimination judicial relief system through the case of Jiang Tao height discrimination,and reveals the underlying reasons for the problems in China's anti-employment discrimination judicial relief system.Third part in Taiwan,the United States and Germany,it has reference significance of the three regions and countries in terms of employment discrimination department regulations control efforts for reference,and then a detailed introduction on the relevant system,thus in employment discrimination legislation,the design of the legal entity and the procedure and the legal responsibility three angles proposed suits our country employment discrimination that the feasibility of judicial relief system construction.
