Chinese Tusi Heritages led by Laosi City of Yongshun have been listed into the World Heritage List,signifying that research on Tusi in China has made phased achievements.However,as far as the research on Tusi is concerned,most scholars start from such areas as politics,economy,culture,social administration,and architecture beauty and few scholars mention law.Therefore,this thesis starts from legal culture and studies Tusi system and Tusi culture in China.First of all,this thesis defines relevant concepts on legal cultural and legal culture of Tusi and points out that legal culture is the sum of legal awareness,legal systems and legal value shown in various aspects of legislation,judiciary,law enforcement and law observation by human beings in the process of social and historical development;legal culture of Tusi is the sum of rich legal awareness,legal system,and legal value standards,rules,regulations and systems and relevant theories,principles,procedure and requirement emerging during Tusi period when the central feudal dynasty implemented the administration system of “using barbarous people to subjugate their own races” in remote barbarous races.Laosi City Heritage is the best preserved ancient Tusi city heritage of the largest scale and the longest history.This thesis cites the case of Laosicheng.First of all,the thesis illustrates the origin and cultural forms of legal culture of Tusi,further studies various systems and cultures in the period before the formation of Tusi system from Qin and Han Dynasties to Tang and Song Dynasties.It is believed that in the early period for the formation of Tusi system,“frontier prefecture system” and “Jimi system” were adopted.Then,based on the analysis of various literature and the comprehensive understandings of concepts by various scholars,the thesis identifies with the idea that Tusi system emerged in Yuan Dynasty,believing that the distinctive Tusi system emerged in Yuan Dynasty,thrived in Ming Dynasty,and declined in Qing Dynasty.Next,starting from such aspects as Tusi social governance and civil customs,this thesis offers concrete explanations on the legal culture of Tusi of Laosicheng in Western Hunan,thereby discloses the Tusi history in Laosicheng that has been hidden for over 800 years,more deeply understands the political system,ethnic regional culture,and social culture that have gone through nine dynasties,and provides historical evidence and references for the research on legal culture of Tusi.Finally,through research,this thesis analyzes the negative impact and referential significance of legal culture of Tusi in Laosicheng of western Hunan and inspires us to select the essence while discarding the gross,inherit critically,and further develop ethnic regional culture and economy,inherit ethnic culture,and build a harmonious society.
