Reseach On System Of Compulsory Summoning Of Public Security Organs In China

The legal system of compulsory summoning is the system basis for guiding and standardizing the law enforcement of public security organs in China,and is the fundamental guarantee for law enforcement norms and civilization.Under the background of deepening the reform of administrative law enforcement system,perfecting the compulsory summoning system of public security organs in China should also be included in the process of administrative legalization.This research follows the research ideas of"knowing problems","discovering problems" and "solving problems",and taking the"Public Security Management Punishment Law" as the main analysis object to conduct an in-depth analysis of the compulsory summoning system of public security organs in China.On the basis of revealing the general theory of the compulsory summons system,this paper combs the current situation of China's legal system from the analytical paradigm of legal doctrine,and then,guided by problems,puts forward corresponding suggestions to improve the existing legal system.Specifically,the connotation of compulsory summons system is initially defined,and on the basis of explaining the disputes of different legal nature of compulsory summons,the theoretical orientation of compulsory summons as administrative compulsory measures is put forward from the perspective of premise,behavior and function.Secondly,from the perspective of legislation and law enforcement,this paper empirically examines the system of compulsory summons in China and the current situation of its implementation,and analyses the problems existing in the current system,such as the ambiguity of the applicable system,the imperfection of the execution procedure system and the lack of supervision and relief mechanism.Finally,this paper puts forward some suggestions to improve the compulsory summons system in China.This paper clarifies the applicable object,reason and timing system of compulsory summons,perfects the approval method and procedure system of compulsory summons,and perfects the internal supervision and external relief mechanism of compulsory summons.
