Research On The Criminal Law Protection Of Citizen's Personal Information

In recent years,with the development of modern information society,the collection and dissemination of personal information have undergone technological changes.Because of the enormous economic and social value of citizens' personal information itself,various kinds of crimes against citizens' personal information emerge in endlessly.Whether citizens' personal information can be effectively protected is of great significance to the security of the whole society,the country and the protection of individual rights and interests.Starting from China's national conditions,it is helpful to study the existing criminal law protection for better safeguarding personal information security and improving relevant legislation.This paper reacher the personal information in criminal law protection from five aspects.At first,it is an basic concept of citizens' personal information.The second part introduces the growth of protect personal information of citizens in our country.The third part uses the method of comparative study,compares the current situation of legislation,and looks for the legal content with reference significance from the foreign legal experience.Next,the author puts forward the defects of the criminal law norms of personal information of citizens in China,such as the vague definition of relevant concepts,the excessive range of statutory penalty provisions,resulting in unbalanced sentencing,the insufficient identification of criminal acts and subjective aspects,and gives some specific solutions,such as clearly defining the concept and classification of personal information of citizens,and strengthening crime.The establishment of subjective aspects of identification,refinement of sentencing standards.In the process of writing the paper,the methods of literature research,text analysis,comparative analysis and case analysis are mainly used.The author believes that the innovation of this paper lies in the suggestion of classifying citizen information,classifying personal information,and refining subsequent penalty measures.
