Jurisprudential Analysis And Legal Regulation Of Algorithmic Discrimination In The Era Of Artificial Intelligence

Algorithms as the core of artificial intelligence,together with the Rapid Progress of Intelligent Robot Technology,not only determine the autonomous decision-making of artificial intelligence,but also penetrate into all aspects of our lives.Algorithmic technology brings human opportunities,but also brings some risks,such as the phenomenon of algorithmic discrimination is becoming more and more prominent.Therefore,when algorithmic discrimination collides with human rational values,the problems brought by it deserve our attention.But in the final analysis,the legal regulation of algorithmic discrimination should return to the regulation of human beings.In the context of weak AI,this paper analyses the risks and impacts of algorithm discrimination.Starting from the two elements of AI-algorithm and data,it analyses the causes,harms and difficulties of algorithm discrimination.Based on the existing legal theory,this paper discusses the necessity of combating algorithmic discrimination,tries to establish and improve the feasible regulatory mechanism of algorithmic discrimination from the legal point of view,so as to mitigate the adverse impact of algorithmic discrimination,and guide the development of algorithmic benignly,so as to make artificial intelligence supported by algorithmic better benefit mankind.
