Research On Legal Regulation Of Algorithm Discrimination In The Field Of Artificial Intelligence

With the development and advancement of computer-based internet technology and artificial intelligence algorithm technology,various emerging technologies and industries constantly spring up.While the advancement of technologies brings convenience to the people,new challenges arise,especially the emerging artificial intelligence,as well as its application,has brought great influence to all levels of the society.The development of internet has provided the “fertile soil” for innovation,and also let the artificial intelligence algorithm gradually become a part of people’s daily lives.In the mean time,the emerging artificial intelligence algorithm has also brought huge impact on social economy and legal ethic,making itself a pretty advanced topic among many scholars in contemporary times.While the investments in artificial intelligence algorithm keep increasing rapidly in various fields,governments around the world and the United Nations are also discussing the impact and significance the development of artificial intelligence has on and for the citizens and the society,and are trying to have regulations on the artificial intelligence industry in the forms of laws and policies,thus providing a good environment for the research,application and development of artificial intelligence algorithm.Our country currently does not have a special regulatory agency in the field of algorithms,and there is no corresponding legal regulation system,but the phenomenon of algorithm discrimination has been emerging in various fields.This paper analyzes the reasons for algorithm discrimination,and the special features of algorithm due to its own professionalism and inherent operating logic,which make the discrimination it produces have the characteristics of concealment and difficulty in proof.It points out that algorithm discrimination can easily lead to reinforcement of social prejudice,etc.phenomenon.At the same time,this article demonstrates the practical necessity and theoretical legitimacy of the regulation of algorithm discrimination,summarizes the current status and deficiencies of the legal regulation of algorithm discrimination in my country’s current system,and introduces the experience of European and American algorithm discrimination governance from the data and algorithm levels.This paper aims to connect the real problems of artificial intelligence algorithm development and application with the law,study the risks and legal challenges of algorithm development in the field of artificial intelligence,combine the current research status and related policies at home and abroad,and propose a method from the two levels of algorithm and data.New algorithmic risk supervision mechanism and legal regulation approach,and advocate the construction of algorithm discrimination prevention concept,establish a special algorithm supervision institution,improve algorithm supervision ability,establish algorithm accountability mechanism,improve the safety and reliability of algorithm decision-making,and increase the public’s understanding of algorithms.At the same time,it proposes to use judicial review as a post-monitoring mechanism to strengthen the review role of judges.At the same time,it advocates the establishment of industry self-regulatory organizations to conduct self-supervision to ensure the sound development of artificial intelligence algorithms.
