At present,the problem of crime is very serious and has become a basic problem in human society.Based on the actual situation in China,we will learn how to absorb the rich criminal education thoughts in our traditional legal culture and build a better crime prevention and control system.This is not only a challenging practical study,but also an extremely important theoretical study.From the moment of the crime,mankind has fought with it all the time.In the process of human society development,scholars from all over the world have made many efforts to solve this series of problems.They have some excellent ideas and theories.Of course,from a strategic point of view,the most effective means of managing crime is prevention.This paper mainly studies the relationship between the ideology of punishment and crime prevention and control in Chinese traditional culture.Indoctrination has always been a basic mode of practice in national governance.Between "virtue" and "punishment",the practice of moralization is not only the exclusive way to rule by virtue,but also has a profound purpose of moralization in the rule of law,thus forming a unique thought of "punishment as a supplement to education,and punishment as a whole".Punishment to teach in the traditional culture thought there are many worthy of our learning place,combining with the construction of "new era of socialism with Chinese characteristics" of real need,around the theme,the duty to study and analysis from four aspects,unearthed punishment teaching ideas about crime prevention and control and the content of the theory,thus the correct understanding sentence teaching idea and the connection between the crime prevention and control.At present,there is very little research on the "criminal education thought",which is only involved in the discussion of Confucianism.Based on the analysis and research on the essence of Chinese traditional criminal education theory,this paper summarizes the concept of "criminal education thought" based on the discussion of traditional Chinese criminal education thought and its methods,that is,China is based on Confucianism.The legal enlightenment thoughts contained in the governance process.Then through a comparative analysis of the relationship between criminal education and education,it is believed that criminal education has always played an important role in the Confucian governance of the country and counteracted the education itself.Then it focuses on the study of criminal education in the main period of ancient China.While studying the historical context of the formation and development of ancient Chinese criminal education thoughts,the author discusses the theoretical core of the "Governing and Defending Criminals".Through the analysis of the academic history of the source of the "German stipulations",and the re-analysis of the relationship between "German" and "Criminal" in Confucianism,summed up the "German" and "Criminal" in the "German and Supreme Court" The relationship is not what was thought in the past.It is the primary and secondary relationship of the means of governance,but the relationship between the levels of governance.In order to better grasp the concept of crime prevention and control contained in the traditional criminal education thought,it is particularly important to examine the social control function of the traditional criminal education in China.By understanding the specific influence of criminal education thoughts on crime prevention and control methods in the important period of ancient China,I thought about how to effectively abandon inheritance and transformation innovation in the essence of criminal education.Due to the public's recognition and inheritance of the excellent traditional law culture,it is possible to discuss the criminal education thoughts for the past.Drawing on the essence of traditional criminal education,realizing the perfect combination of traditional criminal education and social reality in China,especially the role of criminal education in crime prevention and control,and then completely rid of the shackles of feudalism,is the purpose of value conversion.The third part is to return to the present,the conversion of modern values of ancient Chinese indoctrination.The public's recognition and inheritance of Confucian indoctrination makes it possible for us to discuss how to make the past serve the present.The purpose of value transformation is how to achieve a better combination between traditional indoctrination and China's social reality,especially how to give full play to the role of criminal ideology in crime prevention and control and how to get rid of the shackles of feudal ideology.At the end of the article,from the actual situation of crime prevention in China,this paper discusses how to integrate the criminal education thought into the construction of contemporary crime prevention and control system.Based on the analysis of the traditional criminal education thought and the modern crime prevention crime theory,starting from the actual state of China's crime prevention and control system,it discusses the crime prevention and control measures that have appeared and are happening after the founding of New China.And this is reflected and summarized.Finally,we will come out from the tradition and summarize how the current crime prevention and control should reflect the criminal education thought.In summary,from the perspective of the normative theory of modern criminal law,this paper studies the infiltration of the ancient Chinese ethical thinking on the criminal rule of law,and explores the spiritual essence of the traditional criminal education thought.This move is perfect for us to study the crime prevention and control system.When it comes to innovation,it has inspiring meaning and reference value.
