Study On The Problems And Countermeasures Of China's Current Entry And Exit Management System

With the increasing frequency of foreign exchanges in China,more problems are encountered,and the importance of exit and entry management is becoming increasingly prominent.The current exit and entry management system of China mainly uses and adopts the models and practices of the former Soviet Union,most of which are the products of the planned economy.Although there have been a series of adjusting,the problems that are not adapted to the current situation of exit and entry management of “big in and big out,fast in and fast out” have become prominent.There is a consensus on the urgent need to reform the exit and entry management system.In March 2018,the National Institutional Reform Plan proposed to establish the National Immigration Administration,which shall be managed by the Ministry of Public Security.In April 2018,National Immigration Administration was officially launched in Beijing.This series of measures by the country has opened the door to the reform of the exit and entry management system.However,it should be recognized that the establishment of the immigration authority as a subordinate of the public security department does not meet the needs of the times and is inconsistent with relevant international practices.It is not helpful to attract the talents and manage immigration personnel,and it can't effectively solve the shortcomings in the current exit and entry management system in China.This paper puts forward some countermeasures and suggestions on the problems that need to be solved in China's exit and entry management system through the comparative study of the exit and entry management system at home and abroad.This article consists of four parts,the main contents are as follows:The first part is the introduction,which shall focus on the research of current situation of China's exit and entry management,and explain the background and significance of the exit and entry management research.The second part is the the analysis of the current situation of the exit and entry management system at home and abroad.It first analyzes the current situation of China's exit and entry management from the perspective of the functions,and combines the typical or representative of the country's institutional settings to analyse the common international exit and entry management systems of vertical,flat and mixed.The third part is the shortcoming of China's current exit and entry management system.Through comparative research on the exit and entry management system at home and abroad,the author points out the problems existed in China's current exit and entry management,such as multi-management,complicated system,inadequate understanding and response to the situation,conservative legislative concept,imperfect legal system and so on.The fourth part is the countermeasures and suggestions for China's exit and entry management system.Based on the previous research and analysis,the author puts forward countermeasures and suggestions on how to realize the transformation of exit and entry management from “management-oriented” to “service-centered” from three aspects: the establishment of vertical management of exit and entry management institutions from the integration of unified functions,the improvement of legal system for exit and entry management to promote the transition to immigration legislation,establish and improve the visa and foreigner management system which is more in line with international trends and domestic facts,innovating exit and entry management methods relying on emerging technology means.
