Application And Improvement Of Non Custodial Disposition In Juvenile Delinquency Punishment And Prevention

At present,the crime rate of minors is high,the age of crime is getting younger,and the forms and means of crime have new changes and characteristics.How to deal with the current situation and effectively curb and prevent juvenile delinquency has become an urgent problem to be solved in China's judicial field.it is particularly urgent and important to construct a punishment and prevention treatment method that is in line with the physical and mental development of minors and conducive to the correction of juvenile offenders.Imprisonment disposal is still the main form of punishment and prevention against juvenile delinquency.however,in practice,it is not difficult to find that various drawbacks of imprisonment disposal have gradually appeared,such as low success rate of reform,high cost of imprisonment,difficult to return to society and high recidivism rate.it can no longer meet the needs of caring for the growth of minors in current society,but the treatment of juvenile delinquency by non-imprisonment disposal is gradually accepted and adopted by society for its unique advantages and flexibility.In recent years,China has introduced a number of opinions on working regulations to strengthen the guidance of judicial organs on the application of non-custodial treatment to juvenile delinquency.however,there are still some shortcomings in practical application,such as weak operability,unclear power subjects,inconsistent execution links and unclear supervision effect,which greatly reduce the effectiveness of non-custodial treatment.In this article,the author takes the general practice of non-custodial treatment of juvenile delinquency in l district of n city from 2010 to 2016 as a reference sample,and adopts the investigation method and empirical research method to conduct field research on the general situation of non-custodial treatment in this district from 2010 to 2016,analyzes the problems existing in the application of juvenile delinquency prevention,summarizes the obstacles existing in legislation,justice and execution supervision,and puts forward some preliminary and perfect suggestions on the application of non-custodial treatment in juvenile delinquency prevention.
