The escalation of Sino-US trade disputes aggravates the instability of the global economy,and the conflicts of Sino-US economic and trade relations also adds to the uncertainty of politics and diplomacy between the two countries.In addition to the huge deficit of trade in goods,the main reason for the economic sanctions imposed by the United States against China is also the denial of the market economy with Chinese characteristics,which has not fulfilled the promise to make good on WTO rules.On the one hand,the United States is doing so in order to achieve its own economic and political purposes,to consolidate the dominant position of the international community;On the other hand,there are many problems in Chinese market economy,not only the historical legacy of the transformation of the old system,but also the new challenges arising with the changing domestic and international economic forms.But in the final analysis,one of the fundamental reasons for the existence of various problems in Chinese socialist market economy is that the degree of rule of law is not enough,and the legal system supporting the relationship between the current economic operation system and the productive forces is not perfect enough,and it is not timely.To adjust and standardize market order and market economy in an efficient,completely fair and fair way.The main purpose of this paper is to analyze the relationship between economy and law under the background of socialist market economy with Chinese characteristics with legal knowledge,and to explore the law of the development of market economy in China since the reform and opening up to the outside world in the past 40 years by combining theory with practice.Summing up the achievements and experiences,guided by the Chinese issue,based on Chinese national conditions,put forward effective measures to resolve Sino-US trade disputes,and put forward suggestions for improving the rule of law in the current market economy.At the same time,enrich Chinese legal theory research on how to deal with the friction of international trade and the change of global economy.The introduction of this paper briefly describes the causes of Sino-US trade disputes,the history and development of the current situation,and focuses on the topic of the status quo of the study;The second part analyzes and discusses the related theoretical research of law and economy.Firstly,the western developed legal and economic theory represented by the United States,taking its development course as a clue,selects the views of the representative figures.Secondly,the logical starting point of Marxism political economics theory,the analysis method and the theoretical research on the relationship between law and economy are analyzed and summarized.Finally,it briefly discusses the theoretical achievements of socialist political economics with Chinese characteristics.The third part is an in-depth reflection on the rule of law in the market economy,which is based on the background of economic globalization and the reform of the domestic economic system,and analyzes the necessity and measures of the rule of law in the market economy by taking the Sino-US trade dispute as the starting point.The fourth part,combining the current theory and practice,sublimates the full text,probes into the benign interaction between the market economy and the legal system construction in the new era;Finally,the conclusion summarizes the full text,puts forward new challenges and looks forward to the future,puts forward new requirements for the rule-by-law construction of Chinese market economy,and makes constructive legal considerations for dealing with Sino-US trade disputes and the unpredictable international economic market.
