Small and medium-sized enterprises have made great contributions to promoting the healthy development of our economy and society,solving the problem of employment of surplus personnel,and showing more and more strong economic vitality and growth potential.Financing guarantee companies play a supporting role in promoting the stable development of small and medium-sized enterprises,expanding their financing scale,reducing financing costs and improving their market competitiveness.Because of the rapid development,serious polarization and rankless competition of China's financing guarantee companies,the financing guarantee market is chaotic and the operation risk of the financial market is increased.This is closely related to the lack of laws and regulations of China's financing guarantee companies at the present stage,the lack of maneuverability,the large loopholes,the irregular development of the industry and the inadequate supervision,etc.,and the improvement of China's financing guarantee company laws and regulations.The system is very necessary and urgent.Based on the analysis and study of the risks and causes of the financing guarantee companies in China at present,this paper points out the problems existing in the legal regulation of the financing guarantee companies in China,and on the basis of analyzing and drawing lessons from the legal regulation and management experience of the developed countries such as the United States,Britain,Japan and Germany,puts forward the further perfection of the legal regulation of the financing guarantee companies in China.Good suggestions,from improving the legislative level,establishing an effective credit evaluation mechanism,and building an effective legal supervision system,are analyzed on the legal regulation of China's financing guarantee companies.
