With the rapid development of economy,China has been the second largest economy.Chinese consumption capability has been increasingly promoted,which makes in combination with the developed countries in consumer quality request.Pharmaceutical products as a special commodity,has covered not only healthcare areas belonging to mass consumption,but also clinics in the stage of medical treatment.It is everyone's necessities to keep healthy and maintain life.Although there are many reforms of regulation frequently in recent years,relative laws and regulation have been revised several times,Chinese food or drug safety events have emerged frequently,such as QiEr incident(2006),Xinfu incident(2006),Methotrexate event(2007)to today's poison capsule event(2012)and vaccine event(2016).Meanwhile,as a vital component of pharmaceutical industry,Chinese multinational pharmaceutical companies occur violations in compliance,auditing or human resource,such as GSK bribery affair.They have made masses of consumers with many doubts towards Chinese pharmaceutical industry's social mission and company responsibilities.We learn from it that: we can't just reject illegal activities by law,and mortal can't guarantee the maintenance of companies' responsibilities.In western countries,because in special period,there are many academic debates aroused by special requests of companies social responsibilities.On the other hand,the global economic integration process is independent of the "other interests" and the separate existence of "shareholder value" gradually disappeared.Under the context,starting from maintaining masses of consumer's life and healthy rights and take multinational pharmaceutical companies as research object,this paper analyzes the interests relations and restriction relations between pharmaceutical companies and consumers from three important parts of multinational pharmaceutical companies: patent research and development,production and quality control,consumer service,by revealing the formation of a "closed loop" type of social economic relations.This paper explores more effective and direct regulation methods through analyzing the fulfillment situation of well-known western pharmaceutical companies' CSR,and compared from the dimensions of social responsibility of China's existing law and regulations,based on the characteristics and operation rules in the field of the pharmaceutical industry,to achieve the purpose of ‘hard law is more systematic and soft law is more operable'.
