Study On Compensation For Rural Land Acquisition

Land is the fundamental guarantee for the survival and development of the vast number of peasants in China.The continuous advancement of economic globalization and the accelerating process of new urbanization have led to an increasing demand for land for urban construction.Due to the scarcity of land resources,in the face of increasing land demand and tight state-owned land stocks,Collective land acquisition for the development and construction of state-owned land has become the main means of increasing land supply.Subject to the characteristics of China's land system with a strong planned economy era,coupled with the country's comprehensive development level is still low,the rule of law is shallow,and the rule of law is still lagging behind,leading to a series of problems exposed in collective land acquisition.Through the inductive analysis of the OpenLaw legal website and the case on the refereeing documents online,it is obvious that among the series of problems that lead to land acquisition disputes,the most serious problem is the compensation for land expropriation.For example,the principle of imposing compensation is not clear,and the scope of compensation is not Reasonable,uncompensated compensation standards,incomplete compensation and resettlement methods,and imperfect compensation dispute resolution.In the context of the Third Plenary Session of the 18 th Central Committee on the "Decision of the Central Committee of the Communist Party of China on Comprehensively Deepening the Reform of Some Major Issues"(hereinafter referred to as the "Decision"),this paper takes a specific case in the practice of land acquisition compensation in China as an entry point.Thoroughly analyze the land expropriation compensation system and a series of problems exposed in practice,and analyze the causes of the problems,compare the relevant systems and practical experience of typical countries in foreign countries,and tentatively construct the compensation system for land expropriation in China.Improve and provide some shallow reference opinions,in order to draw lessons from China's land acquisition compensation practice,while promoting the smooth implementation of national land acquisition work,it can fully protect the vitalrights and interests of land-losing farmers and contribute a small force to the new urbanization construction.Promote the harmony and stability of society and the long-term stability of the country.
