With the continuous development of the retail industry,research and discussions on the question of whether supermarkets charge extra fees are reasonable and legitimate have intensified.In particular,theories that identify whether their actions use comparative advantage have emerged.Many scholars have adopted and to analyze the related problems of using the theory.The academic opinion on the issue of additional fee collection focuses on the two areas of economics and law.The economics point of view is mainly to explain the rationality of the existence of objective economic phenomena.Usually,it does not judge the propensity of its value.It analyzes the main contents and conclusions of the causes,basis,and usage of additional feescollected by supermarkets.The analysis of law tends to be whether the dominant position of the dominant position abuses its dominant position to collect additional fees,which is mainly reflected in the unbalanced supply and demand of the additional costs incurred,and how to judge its reasonable legality.Most of the arguments considered that supermarkets excessively use the comparative advantage position to collect additional fees not only undermine the principle of fair and voluntary market transactions,but also undermine fair and free market competition order.Large-scale supermarket chains often set up complete sales channels in the form of uninterrupted shops in one city or even across the country,forming a certain brand effect among consumer groups.Therefore,suppliers depend on the sales channels owned by supermarkets,so supermarkets can use their unique channel resources to charge suppliers an additional fee to exchange benefits.But in fact,the comparative advantage will change according to the development of market economic activities,and the roles of both the supply and demand sides will change accordingly.The scale of retailers is getting bigger and bigger,and they are constantly flowing into newly opened stores held by or merged by capital giants.The right of the relative suppliers to choose freely is also improved,the discourse right of the big brand suppliersis increasing,and the strength of the related industry association can not be ignored.In some cases,the retailer or supplier does not have a large advantage in the market share it occupies,but in the transaction it can show relative advantages over the other by its unique resources or channels.The arrival of the new retail era means that the traditional supermarket industry has undergone tremendous changes,the relative position of both supply and demand has changed,the discourse power and the right to choose suppliers is growing,and the traditional supermarket as a sales platform between suppliers and consumers,with the change of business model and the transaction relative to the supplier,if it does not conform to the changes of the times,the supermarket does not in fact have a relatively strong right to speak.Therefore,whether the behavior of supermarkets charging excessive fees is a matter of excessive use of comparative advantage cannot be generalized,and it is necessary to judge whether the behavior is reasonable and legitimate by the actual situation.Therefore,this topic will begin with the characteristics and changes of the commercial model of the supermarket industry at present,thinking and discussing the change of the role between the practice of supermarket charging and the role of supply and demand,and using the means of economic analysis and legal theory to study the theoretical meaning andpractical value of the relative superiority status.Through detailed analysis of the transformation of the mode of cooperation between supermarkets and suppliers under the current economic situation of new retail,the legal nature of the behavior is identified by the typical performance of relative dominance behavior,and then the conclusion is different from the current mainstream viewpoint.
