On The Legal Regulation Of Outer Space Security Under The Guidance Of The Overall National Security View

With the deepening of space activities,human society's dependence on outer space is increasing,while the factors threatening the security of outer space are increasing.The increasing trend of weaponization of outer space and the increasing number of space debris pose a great threat to the security of space assets,thus endangering national security and the overall security of the international community.At the domestic level,China's space legislation level is not high,the system is not perfect,can not effectively protect China's space interests and national security,but also is not conducive to China's implementation of international obligations to guarantee the security of outer space.At the international level,the international treaties on outer space security generally have the drawbacks of ambiguity and principle,which leads to the disunity of the standards for the implementation of treaties by all countries.These problems make the security of outer space not effectively guaranteed and need to be perfected urgently.Against the background of the new era,General Secretary Xi Jinping put forward the overall national security view,which contains the profound connotation of paying attention to common security and advocating international cooperation,which not only lays a theoretical foundation for the Perfection of China's space security legal system,but provides a new way of thinking for the formulation of international Law on space security.In particular,the cooperative thought contained in the overall national security view enriches the content of outer space security cooperation and promotes the transformation of the mode of cooperation in outer space security,and then promotes the formulation of legal norms for outer space security.Under the guidance of the overall national security view,space security legislation can be improved at two levels,both domestic and international: at the domestic level,we should speed up the adoption of the space law,improve China's outer space security legal system,and guarantee the interests of our outer space while better fulfilling the corresponding international obligations.At the international level,in addition to improving the China-Russia joint PPWT draft,comprehensive mechanism including space traffic management rules should be established,thus finalizing an effective international measure to prevent the weaponization of outer space and the governance of space debris and to guarantee the security of outer space.
