Research On The Administrative Law Enforcement Of China's Cultural Relics

Cultural relics are precious and non-renewable resources of history and culture,which carry excellent traditional Chinese culture,and accumulate the wisdom of the ancients.Strengthening the protection of cultural relics is playing an important role in inheriting Chinese civilization,enhancing national cohesion and promoting economic and social development.In 2002,the Law of the People's Republic of China on the Protection of Cultural Relics was revised comprehensively.The number of articles has increased from 33 to 80,of which Articles 66,68,70 and 71 stipulate the administrative law enforcement power of the cultural relics department.Thus,the administrative law enforcement of cultural relics in China has been carried out.In recent years,the Party and the government have attached great importance to the protection of cultural relics,promulgated a number of special principles and policies,and constantly improved the relevant laws and regulations.So China's cultural relics industry has made remarkable achievements,and the administrative law enforcement work of cultural relics has made continuous progress.However,with the acceleration of urbanization,the contradiction between urban construction and cultural relics protection has become increasingly prominent,and the cultural relics destruction phenomenon in urban construction has been not uncommon.At the same time,the security situation of cultural relics is also very serious.Criminal activities such as excavation,robbery and smuggling cultural relics are rampant,and the theft of the Forbidden City is a wake-up call to the whole society.With the increasing popularity of private collection,the antique market has been developing rapidly,and many illegal behaviors such as the illegal operation of cultural relics and the illegal sale of cultural relics,have emerged.Due to insufficient supervision,the circulation market of cultural relics is in disorder,which increases the difficulty of administrative law enforcement of cultural relics.On the basis of detailed literature research,this paper improves the concept of administrative law enforcement of cultural relics.Starting from the analysis of the current situation of cultural relics administrative law enforcement in China,this paper holds that the government attaches more importance to the work of cultural relics administrative law enforcement in China;the system of cultural relics protection laws and regulations has been initially established;the construction of law enforcement agencies is accelerating;the work of cultural relics administrative law enforcement continues to strengthen.At the same time,combined with the typical cases of cultural relics administrative law enforcement in China,it summa-rizes the difficulties faced in the work of cultural relics administrative law enforcement,mainly include: difficult execution of legal person illegal cases,weakened administrative powers of cultural relics administrative institutions,shortage of funds for cultural relics protection,and lack of cultural relics protection responsibilities of the government and relevant departments.In view of these problems,this paper,through careful study,puts forward the corresponding countermeasures.It believes that it is necessary to strengthen the publicity of cultural relics legal system,strengthen the construction of cultural relics administrative law enforcement capacity,strengthen the supervision and management of cultural relics administrative law enforcement and strengthen the department joint law enforcement and regional cooperation to ensure the smooth progress of cultural relics administrative law enforcement work.
