Research On The Legal Framework Of Creation And Operation Of Legal Entities In The Chinese-belarusian Industrial Park

The main goal of this thesis is to conduct comprehensive analyze of existing regulations governing creation and operation of legal entities in the Industrial Park,to identify general legal regulation issues in the area.Offering solutions to these problems and protecting interests of legal entities in the industrial park is the goal to be achieved.During the research,I used scientific research methods such as historical research,comparative research,legal statistics research,legal modeling research,formal legal research and legal prediction research methods.For the research,I used the legislation of the Republic of Belarus,interstate agreements between the Republic of Belarus and the People's Republic of China,the established practice of the industrial park's management bodies functioning.The investigation of Belarusian,Russian and Chinese legal literature authors was conducted as well.Special issues of the industrial park functioning,the functioning and creation of legal entities on the territory of the Republic of Belarus are main issues addressed to the source data.Conducting analysis of legal norms governing the legal entities' creation on the industrial park's territory,I have investigated the legal entities' organizational forms,the procedure for creating and registering these legal entities(depending on the type of activity they perform)in the industrial park's territory.In the area of creating legal entities,the main issues are related to the gap in the legal regulation of foreign legal entities' names protection,as well as the imperfection of legal regulation in the sphere of economic activities of industrial park's non-commercial legal entities.During the analysis of legal norms governing the operation of legal entities in the industrial park,I investigated the functioning of legal entities' management bodies(depending on the organizational form),and investigated the types of industrial park's legal entities reorganization.In the area of legal entities functioning,the main issues are related to the contradiction of legal norms regulating the functioning of a “Joint Chinese-Belarusian company for the development of the Industrial Park”,as well as the imperfection of notifying investors on reorganizing a legal entity.The result of the research is a comprehensive answer to the issues investigated in the thesis,proposals for improving legislation in the field of Industrial Park's legal entities creation and operation.
