Legal Issues Study On The Financial Support Of The New Agricultural Management Entities

The "three rural" problem is the key issue of the national economy and the people's livelihood,and the development of agriculture plays an important role in supporting the economic construction of our country.The nineteen most recent reports of the Communist Party of China start from the national conditions.It is put forward that the biggest development of our country is not enough.The rural development is not enough.It requires our country to carry out a comprehensive Rural Revitalization Strategy and promote the comprehensive upgrading of agriculture.In the process of expansion,the main body of new agricultural management has become the key force.The central file of2016 stressed,"to promote agricultural innovation driven,based on supply side structural reform","actively cultivate professional large,family farms,farmers' cooperatives and leading enterprises of new agricultural business entities".In recent years,with the rapid development of new agricultural business entities in China,the demand for financial resources is increasing.However,because of the properties of its weak agricultural industry and the profit characteristics of the financial institutions,the new agricultural management is difficult to fully obtain the financial supply that can meet the needs of its production and management.This requires the government to face the rational allocation of rural financial resources,effectively control,and provide legal protection for the financial resources to the new agricultural management.How to solve the legal problems existing in the development of the new agricultural operation subject of financial support should be a problem to be solved at present.First of all,this research has made the overall summary of the new agricultural business entities,the difference with the traditional farmers were compared,and several main types of its characteristics and contains an overall description,and based on expounding the meaning of rural finance and financial support,focusing on the related legal theory and economics theory.That support the theoretical basis of this paper contains.Then,the legal laws and regulations policy combing the financial support of new agricultural business entities from the state,the administrative department and localgovernment three aspects,followed by the Hubei financial support to investigate the overall situation of the development of new agricultural business entities,to study the radiation properties,and found that the existing legal problems in development the financial support of new agricultural business entities in China on the basis of practical considerations.Again,through the investigation of several typical countries,such as the United States,France,Japan's agricultural financial support of the legal system,through the comparison of America,France and Japan three countries agricultural financial support legal system,summed up the similarities between them in the policy and practice of financial support,the reference to China's enlightenment.Finally,on the basis of the basic principles of establishing the interpretation of financial support for the development of new agricultural business entities,from the legal status,clear the new agricultural business entities sound financial support for the development of new agricultural business entities,improve the legal system of the three dimensions of policy incentives and financial measures to support new agricultural business entities in the development of the legal issues of financial support for the development of model of agricultural management countermeasures.
