Research On The Legal Problems Of The New Agricultural Management Entities

After entering the 21st century, China has been made remarkable achievements in the development of agriculture and the increase of farmers’ income. But the agricultural development of our country still faces many constraints, such as the shortage of agricultural basic resources, the rising production cost, the low quality of management, the lack of the laws and regulations of agriculture, and so on. To break through the restriction and solve the dilemma, we must speed up the transformation of agricultural development mode in our country.In 2015, CPC Central Committee on the Formulation of National Economic and Social Development of the Five Thirteenth Year Plan" clearly put forward that our country must accelerate the transformation of agricultural development mode, improve the quality benefit and competitiveness of agriculture and achieve significant progress in agricultural modernization. This is a major strategic plan of the CPC Central Committee with a view to the overall situation of socialist modernization and the new challenges in the development of Agriculture. And in the process of accelerating the transformation of agricultural development mode, the new agricultural management entities play an important role. Since 2012, the concept of new agricultural management entities was put forward formally in the Central Committee of the Communist Party of China rural economic work conference. As one of the most active and fundamental elements of agricultural modernization, the new agricultural management entities has been widely concerned by the society and academia. Academic works of new agricultural management entities have emerged in endlessly, but most of these academic works analysed the new agricultural management entities in the agriculture and economy, and the research about the legal aspects are very. In fact, because our country is in the transition period to the transformation of the agricultural modernization, and the laws and regulations matched with agricultural modernization are still not perfect, even some aspects of the laws and regulations have not yet formed, which result in new agricultural business entities in the social practice encountering a series of legal problems. For example, financial difficulties, imperfect agricultural insurance system, unsound laws about rural land contract management rights, unclear legal status of the new agricultural management entities, and so on, which has greatly restricted the development of new agricultural management entities, and it is imminent to solve the legal problems in these areas. Therefore, this article will focus on the legal issues which new agricultural business entities faced with in the practice, and put forward relevant legal recommendations.
