On Legal Governance Of "Unreasonable Low Price Tourism"

In recent years,with the total number of tourists in China increased year by year,and the level of tourism service improved continuously,tourism has become a necessity in people's life.However,some tour operators take advantage of the tourists' desire for cheapness to attract low-priced tourists,and then make illegal profits through deception and compulsory shopping.The existence and development of this “unreasonable low price tourism”,as well as the complaints and various problems caused by it,have seriously affected the rapid,healthy and orderly development of tourism industry and the good experience of tourists in China,and largely restricted the overall quality and level of tourism development in China.Through the methods of literature analysis,case analysis and comparative study,we systematically introduced the concept of “unreasonable low price tourism”,business model,nature,characteristics,development status,etc.,and then deeply analyzed its manifestation,harmfulness and causes.At the same time,we discussed the achievements in the management of “unreasonable low price tourism” in China,and the deficiencies in legislation,law enforcement,judicial and social supervision.On this basis,we put forward some suggestions and countermeasures to deal with “unreasonable low price tourism”.The paper consists of five parts:In part one,we elaborated the research background of “unreasonable low price tourism”,summarized the current research situation of the causes and legal governance,clarified the necessity of governance of "unreasonable low-price tour",and introduced the research methods as well as the innovations.In part two,we summarized the current situation of “unreasonable low price tourism” by analyzing the concept,business model,nature and characteristics,and introduced its production process,manifestation and typical cases.On this basis,the harmfulness and causes of “unreasonable low price tourism” are analyzed emphatically.In part three,we analyzed the current governance achievements of “unreasonable low price tourism” mainly from the legal regulation,law enforcement system,judicial system and social supervision aspects,and further analyzed the legal problems in governance of “unreasonable low price tourism” from above four aspects.In part four,aiming at the legal governance of “unreasonable low price tourism”,we proposed some specific countermeasures and suggestions,including amended the “Tourism Law” and other relevant laws;established and completed relevant systems;improved the law enforcement system and judicial system;given full play to the social supervision role of tourism industry associations,the public and the media,and advocated the establishment of rational consumption concept,etc.In part five,we summarized the full text,and hold that we should establish a mechanism combining long-term supervision with centralized management by building a perfect legislation and system,law enforcement,judicial system and social supervision system,combining pre-prevention with post-treatment,in order to eliminate “unreasonable low price tourism” fundamentally.
