Study Of Legal Issues Of Cyber Terrorism Crime Identification

With the rapid development of network technology,network not only brings convenience to people's production and life,but also increasingly becomes the main way and means for terrorists to implement,disseminate and incite terrorism.Cyber-terrorism crime,as one of the new forms of terrorism crime in the cyber-information age,has the characteristics of concealment,easy diffusion and great influence.It brings great threat to world peace and development,brings great trauma to people's psychology and spirit,and seriously destroys social harmony and stability.So the blow is even more important and urgent.Along with the emergence of cyber-terrorism crime,many foreign countries have promulgated corresponding laws to identify and combat cyber-terrorism crime,and accumulated a lot of very effective experience in combating and preventing cyber-terrorism crime.China's Criminal Law Amendment(nine)and Anti-terrorism Laws,which were promulgated in 2015,provide a more comprehensive and solid legal guarantee for our country to combat terrorist crimes,and fill many gaps in the identification of terrorist crimes in the past.However,China's criminal law for the identification of cyber-terrorism crime is still insufficient,needs to be further improved.This article mainly elaborates through four parts:The first part explains the concept,characteristics,background and the harm to society of cyber-terrorism crime.Cyber-terrorism crime is a new manifestation of traditional terrorism crime in the network era,but it is not a simple overlap of cyber-terrorism crime and traditional terrorism crime.Cyber-terrorism crime has its own unique characteristics of concealment and integration,so it is more difficult to crack down,cyber-terrorism not only poses the threat to national political security,but also seriously damages the healthy development of the nation's economy.The second part introduces the constituent elements of cyber-terrorism crime,analyzes the subject,subjective aspect,object and objective aspect,and identifies two manifestations of cyber-terrorism crime,namely instrumental cyber-terrorism and targeted cyber-terrorism(cyber-terrorism attacks).The third part studies the present legislative situation of cyber-terrorism crime in foreign countries,and studies how to identify the scope,jurisdiction and penalty of cyber-terrorism crime in the international field.The fourth part discusses the current situation and shortcomings of the legislation of cyber-terrorism crime in China,and analyzes how to regulate and cognize the criminal law of individual cyber-terrorism crime and cyber-terrorism attack.
