The Reflection And Perfection Of Our Criminal Legal Aid System

Criminal legal aid refers to the judicial system in which criminals provide free legal services to people with financial difficulties or other difficulties in litigation in criminal cases.With the steady implementation of judicial reform,China has paid more and more attention to the implementation of the concept of "people-oriented" and "protecting human rights" in the legal system and judicial practice.However,in the criminal proceedings in China,the people who are prosecuted are often due to various reasons.The inability to obtain effective legal services is,to a certain extent,inconsistent with China's philosophy of attaching importance to human rights protection.Looking at some countries with relatively developed rule of law,in contrast,China's criminal legal aid system has certain problems in legislation and judicial practice.For example,the scope of assistance is narrow,and the division of labor between the parties is legal.It is not clear,the concept of legal aid needs to be improved in all sectors of society.In order to comply with the trend of judicial reform and further improve China's judicial system,it is especially important to explore and improve the criminal legal aid system in line with China's national conditions on the basis of drawing on the advanced experience of other countries.This paper mainly discusses from four aspects.The first part mainly introduces the general theory of China's criminal legal aid system.This part gives an overall grasp of the concept and connotation of criminal legal aid.The second part introduces the history and current situation of China's criminal legal aid system,and analyzes the main problems of the system at the present stage in China.The third part is the investigation and reference of foreign criminal legal aid system.It is intended to explore the reference to my system through the summarization of different legal systems and advanced experience of the country.The fourth part is the improvement of China's criminal legal aid system.It mainly proposes its own ideas from the perspectives of legislation and judicial practice,with a view to making China's criminal legal aid system play its due value.
