Research On The Present Situation And Countermeasures Of The Crimes Of Infringement On Citizens 'personal Information In China

With the advent of the information age,the importance of personal information is becoming increasingly prominent,and the criminal situation of violating citizens' personal information is becoming increasingly complex.The particularity of personal information protection doomed the difficulty of case management.In order to deeply explore and analyze the crime of infringing citizens' personal information,the author,through case analysis,summarizes the characteristics of the crime of infringing citizens' personal information in China,analyzes the causes of the crime of infringing citizens' personal information in China,and on this basis,puts forward the prevention and control countermeasures of the crime of infringing citizens' personal information.Through the research on the crime of infringing citizens' personal information,it can provide some theoretical guidance for judicial practice and better prevent and control the crime of infringing citizens' personal information.This paper is divided into four parts:The first part is the concept definition.On the basis of sorting out the definition of personal information by domestic and foreign scholars,this paper summarizes the characteristics of personal information,puts forward the concept of personal information right,and on the basis of referring to the academic circle and relevant legislative provisions,defines the concept of crimes against citizens' personal information.The second part is the current situation of the crime of infringement citizen's personal information.Based on the analysis of typical cases,this paper summarizes the general situation,characteristics of criminal subjects,characteristics of victims,regional characteristics of crimes,characteristics of means of crimes and the consequences of crimes.The third part is the analysis of the causes of crimes infringe citizens' personal information in China.From the crimes of infringing citizens' personal information crimes,victims,government supervision,industry self-discipline,investigation dilemma,laws and regulations,analyze the causes of crimes against citizens' personal information.The fourth part is the prevention and control countermeasures against the crime of citizen's personal information in China.Based on the above reasons,fully consider the shortcomings in the current work and reference the advanced experience at home and abroad this paper puts forward the prevention and control measures against China's citizens' personal information crimes from the aspects of strengthening civic education,strict government supervision,clarifying industry self-discipline,enhancing technical protection,multi-party cooperation and common governance,improving laws and regulations,and smoothing remedies.
