Research On The Current Crime Of Violent Wounded Doctors In China

At present,there are still many disharmonious factors in the doctor-patient relat ionship in China,and violent medical crimes are also frequently reported.Compared with doctor-patient disputes and medical troubles,violent medical crimes are more extremely and harmful.This paper analyzes and studies violent medical crime fro m the perspective of criminology,and hopes to provide some reference for judicial practice and promot the construction of harmonious doctor-patient relationship in C hina.In order to study the violent medical crime more objectively,this paper collect ed more than 1,000 cases in the Chinese refereeing papers with the words "violent injured doctors,beaten doctors,beaten nurses,beaten medical personnel".After anal yzing the collected cases,according to the complete,comprehensive and consistent r esearch conditions of the case information,366 cases were selected.Analysis of the number of crimes,subjects,victims,time and space characteristics and harmful co nsequences of violent medical crimes and summarizes the causes of violent in detai l,and proposes corresponding prevention and control measures.This paper is divided into four parts:The first part is the concept definition.Combine existing research to sort out t he concepts of violence,violent crime,and violent medical crime.In view of the f act that the academic community has not yet defined the crime of violent medical crimes,this paper draws on the World Health Organization’s explanation of hospital workplace violence,and combines the analysis of violent wounded crime cases to define violent medical crimes.The second part is the analysis of the current situation and characteristics of vi olent medical crimes in China.By sorting out the collected cases,summarizes the c haracteristics of the number,subjects,victims,time and space characteristics and ha rmful consequences of violent medical crimes in China.The third part is the analysis of the causes of violent medical crimes in China.From the subjects level,the victim level,the hospital level,the legal system level,the medical system level and the media level,it is concluded that the occurrence of violent medical crimes between doctors and patients is the result of internal and external causes.The fourth part is the research on the prevention and control countermeasures of violent medical crimes in China.On the basis of the analysis of the third part o f the crime,combined with the current situation in China,and drawing on the prac tical experience of extraterritorial and some advanced areas in China,we will enhan ce the legal awareness and establish a correct concept of medical treatment from th e criminal subject;the victim will improve the protective skills;the hospital will i mprove the security,improve management;strengthen legislative enforcement;promo te medical system reform;regulate media reports and other aspects of prevention an d control of violent medical crimes.
