Research On The Governance Of Cyber Violence Crime

With the rapid development of the times and the large-scale popularization of the Internet,cyber-violent crimes have sprung up,and the harmful consequences have become more serious.This paper mainly discusses cyber violence that can be characterized as criminal behavior in criminal law,and puts cyber violence into the field of criminology for research.The first is the definition of the concept of cyber violence crime.Then it analyzes the current situation of cyber violence crimes in China,and classifies and analyzes the cyber violence crime cases handled in judicial practice in recent years.According to the case,the subjective characteristics and objective characteristics of cyber violence are summarized.The subjective characteristics involve the gender,age,cultural level,occupational stability and recidivism rate of the criminal subject.The objective characteristics include the relevant crimes,the object of the violation,the area where the crime occurred,The complexity of the evidence,the greater harmfulness of the crime,and some research on the declaration of punishment.Then based on the characteristics of crime,the author analyzes the subjective and objective reasons for cyber violence crime.Finally,based on the reasons,the paper proposes specific prevention and control countermeasures for cyber violence crimes,and the countermeasures are proposed from the subjective and objective levels.
