Research On The Investigation Countermeasures Of Property-invasion Homicide Cases

Homicide cases are the criminal cases of the greatest social harmfulness and subjective evil intention.In the current investigative practice,homicide cases of property infringement have been a kind of criminal cases of greater challenges in investigation and cracking;moreover,they could easily become long-pending cases or develop to series cases,causing serious social impacts.For these reasons,they have been the difficult point of homicide case investigation.Due to the difficulty in case finding,unclear causal relationship and uncertain objects of infringement of property-encroaching homicide cases,the investigation and cracking of such cases have been found difficult in general.The occurrence of malignant property-encroaching homicide cases would result in extremely negative influence on the society.Therefore,investigative departments must take effective countermeasures while uphold the clearance of homicide cases as the bottom line of stability and people's safety and the highest pursuit of criminal investigation.This paper is divided into four parts.Part 1 is the introduction part,in which the author summarized literature on homicide cases at home and abroad and introduced the research methods herein.In part 2,the overview,the author mainly expounded the idea,behavioral identification and legal cognition of homicide cases and property-encroaching homicide cases.Combined with examples of property-encroaching homicide cases published on China Judgments Online over the past decade,in part 3,the author analyzed present situation of property-encroaching homicide cases on the whole and looked deep into characteristics of such cases and summarized the same with a case of such kind in a city in Shandong province as an example.Part 4 presented difficulties in investigation;based on the characteristics and relevant examples of property-encroaching homicide cases,the author concluded difficulties in the investigation of such cases into four aspects,namely the difficulty in discovering such cases,the difficulty in finding of the nature of such cases,the difficulty in locating suspects and a relatively large number of long-pending cases.Part 5 presents the countermeasures in investigation,which are the main body and the innovation of this paper.In this part,based on the analysis of the present situation,characteristics and difficulties in the investigation of property-encroaching homicide cases,the author pointed out the thread of thinking referring to related cases he took part in during internship: expand the perspective of investigation with multi-dimensionally-viewed case analysis and trajectory investigation;draw support from YSTR technology,psychological profiling technology,video investigation technology,the prefix stolen-goods controlling technology and other investigative techniques,the prefix stolen-goods controlling technology and other investigative techniques,combing with crime scene investigation and other traditional investigative measures,aiming to provide effective countermeasures for public security organs' cracking of such cases.
