Research On The Relationship Between Network Media Supervision And Judicial Independence

With the emergence of network media,the relationship between media supervision and judicial trial presents a new trend.On the one hand,the main body of network media supervision is more extensive and diversified,which strengthens its supervision function;on the other hand,its own characteristics make the power of network media too strong,leading to an unbalanced state between it and the independence of trial.The purpose of this paper is to explore the relationship between network media supervision and judicial independence,and to reduce the conflict between them by studying the characteristics of network media,the process of network media supervision affecting the trial and the factors affecting it,so as to try to form a balanced relationship between them.There are five parts in this paper.The main contents of each part are summarized as follows: The first part is the introduction.This part includes the proposition of research questions,concisely narrates the relevant research at home and abroad,and clarifies the significance of the research.The second part is an overview of judicial independence and media supervision.This part discusses the definition and value of judicial independence,and focuses on the general relationship between judicial independence and media supervision.The third part,the characteristics of network media supervision and its impact on the trial.This part elaborates the characteristics of the network media,and through the analysis of typical cases,analyses the influence process of the network media supervision on the trial of cases.The fourth part,the tension between the freedom of the network media and the independence of the trial and the analysis of the reasons.This part elaborates the tension between the two and its causes,laying the foundation for establishing a balance between the two.The fifth part is the construction of the balance mechanism between the supervision of network media and the independence of trial.Considering the perfection of legislation and the selfdiscipline of the media profession,we should form the corresponding regulatory mechanism to ensure a balanced relationship of benign interaction between the two.
