The Relationship Between Media Superintend And Just And Fair

With the gradually more attention paid by the public, media supervision has become an important power of social supervision which plays an irreplaceable role in maintaining justice, revealing justice corruption. However, the more powerful the media's supervision acts to justice, the more visible the conflicts becomes between them. Then to this situation, the justice system's responsibility can not be ignored besides the media's supervision lack justice system in criterion. Justice can not go without media's just supervision; meanwhile, media supervision needs tolerance of judicature. Therefore, it is the ultimate aim of this paper which I'll try my best to pursuit that how to harmonize the relationship of them and decrease the side-effect to the lowest so as to make media supervision be a more active and secure role in our country's justice construction.This paper is divided into three chapters. The first chapter introduces the concept of the media, the judicatory and the justice as well as the mutual-relationship between them. The media, including newspapers, journals, radio, television, and the media supervision ,as the carrier of mass media which report, comment or criticize to all kinds of violations of law , and in particular , expose the crimes of the country's public servants including dereliction of duty as well as corruption. Judicial justice is the supreme value target, including public trial, judicial justice and judicial independence. The second chapter focuses on the representation of the conflicts and the regional reason. Today, the power of the Chinese media on judicial supervision is also appearing gradually. We should also focus on the negative-impacts of the over-exaggerating reports, while we sing highly to the positive roles. The reality is that the news media's supervision is not enough to the judicial activities, and the social pressure has not been formed meanwhile; on the other hand, the indiscriminate reports also affect the fair of the judicial activities. Then the so-called social impact has almost become the main indicator of social harm of the parties. The third chapter focuses on how to solve the conflicts, and the construction and promotion of our country's media supervision system. By absorbing and using for reference of the ways and methods took by western countries to deal with this kind of problems, mainly according to the Unit States, the Great Kingdom and Germany, we'll try to seek and design the media supervision system which suit to our basic national situation.
