In recent years,the application of the Internet has gradually penetrated into all aspects of people's clothing,food,housing and transportation from the initial communication role.The organic combination of Internet and finance has spawned Internet finance based on meeting the needs of the wealth preservation and appreciation of the masses and the financing needs of the suppressed vulnerable groups.As an emerging payment technology,third-party online payment technology is increasingly favored by consumers and the trading market.On October 18,2017,General Secretary Xi mentioned the concept of "three major battles" for the first time in the report of the 19 th National Congress.In response to financial risks,he proposed "to resolutely fight against major risks." Third-party network payment is an important part of e-commerce in the "Internet +" environment.Due to the open environment of the Internet and the efficiency of information transmission,once a third-party online payment platform has problems,it is likely to cause systemic risks in e-commerce.This in turn affects all aspects of national,social and personal life.Therefore,it is imperative to establish a sound legal system for the supervision of third-party online payment platforms in order to effectively supervise the risks that may occur in third-party online payment platforms.Structurally,this paper details the basic concepts of third-party online payment platforms,including concept definition,nature,function and value analysis.By combining the literature research method and the empirical research method,the paper analyzes the data and analyzes the third-party network platform companies represented by Alipay and Tenpay.It elaborates on the survival of the third-party online payment platform market in China today.Status,trends and current regulatory status.According to the empirical analysis and the status quo of the third-party online payment platform supervision system,the possible loopholes are found,from the perspective of the regulatory body,the market access exit angle,the financial payment risk perspective and the information security protection.Combined with China's national conditions and the actual situation of market operation,this paper puts forward constructive opinions on the above-mentioned angles,and puts forward four solutions to build a regulatory legal system,clarify the market access and exit mechanism,strengthen financial payment risk prevention and control payment construction and improve information protection.The plan is to improve the legal system of third-party online payment supervision in China,maintain the stable operation of the social economy,and promote the healthy,stable and stable growth of the national economy.
